ՀՀ Ազգային ժողովի նախկին պատգամավոր, գործարար Սամվել Ալեքսանյանը դատի է տվել Երևանի քաղաքապետարանին՝ քաղաքապետ Հայկ Մարությանի կայացրած որոշման համար։ Հայցը մակագրվել է Վարչական դատարանի դատավոր Ռուզաննա Ազրոյանին։ Այս մասին տեղեկանում ենք Դատական տեղեկատվական համակարգից։

Ալեքսանյանը դիմել է Վարչական դատարան Երևանի քաղաքապետի 2020 թ․ սեպտեմբերի 16-ին կայացրած թիվ 2898-Ա որոշումն անվավեր ճանաչելու պահանջով։ Ըստ որոշման՝ Երևան քաղաքի Մալաթիա-Սեբաստիա վարչական շրջանի Շրջանային փողոցի հ.102/4 հասցեի հետնամասում, պետական սեփականություն հանդիսացող հողամասում, Սամվել Ալեքսանյանն իրականացրել է ապօրինի շենք-շինությունների կառուցման շինարարական աշխատանքներ, ինչի համար էլ քաղաքապետարանում վարչական վարույթ է հարուցվել։ Քննարկումների արդյունքում գործարարին գրավոր առաջարկվել է սեփական նախաձեռնությամբ ձեռնարկել քայլեր՝ ինքնակամ շենք-շինությունները քանդելու և դրանցով ծանրաբեռնված պետական սեփականություն հանդիսացող հողամասերն ապօրինի տիրապետումից ազատելու համար, սակայն վերջինս այդ ուղղությամբ որևէ քայլ չի ձեռնարկվել:

Երեւանի քաղաքապետ Հայկ Մարությանը որոշել է չօրինականացնել Մալաթիա-Սեբաստիա վարչական շրջանի, Շրջանային փողոցի հ.102/4 հասցեի հետնամասում գտնվող՝ պետական սեփականություն հանդիսացող հողամասում, ինքնակամ կառուցված շենք-շինությունները, քանի որ հիմնավորվել է, որ այդ ապօրինի կառուցված շենք-շինությունները և պարիսպը ենթակա չեն օրինականացման, որովհետև ընդգրկված են անտառային նշանակության հողերում։

Քաղաքապետի կոմից հանձնարարվել է Մալաթիա-Սեբաստիա վարչական շրջանի ղեկավարին Երևանի քաղաքապետարանի աշխատակազմի քաղաքաշինության և հողի վերահսկողության վարչության ու հասարակական կարգի պահպանության ծառայության օժանդակությամբ քանդել ինքնակամ կառուցված շենք-շինություններն ու ապօրինի տիրապետումից ազատել պետական սեփականություն հանդիսացող հողամասը:
