Դատարանը բավարարել է ցմահ դատապարտյալ Արթուր Քոչարյանի ներկայացուցիչների բողոքը: Այս մասին հաղորդագրություն է տարածել ՀՔԱ Վանաձորի գրասենյակը:

Հաղորդագրությունում, մասնավորապես, ասվում է. «2019 թվականի հոկտեմբերի 14-ին 2005 թվականից ցմահ դատապարտված Արթուր Քոչարյանի գործով վարույթն իրականացնող մարմինն ընդունել էր որոշում՝ ռազմական ոստիկանության աշխատակիցների նկատմամբ քրեական գործով վարույթը կարճելու և քրեական հետապնդում չիրականացնելու մասին: Ա. Քոչարյանի խնդրին ՀՔԱՎ-ն անդրադարձել է նախորդ հրապարակումներում:

Որոշման դեմ Ա. Քոչարյանի պաշտպաններ, ՀՔԱՎ գրասենյակի փաստաբաններ Արայիկ Զալյանը և Անի Չատինյանը բողոք են ներկայացրել ՀՀ գլխավոր դատախազին: Գլխավոր դատախազության` Հատուկ քննչական ծառայությունում մինչդատական վարույթի օրինականության նկատմամբ հսկողության պետի որոշմամբ այն մերժվել էր:

Գտնելով, որ վարույթն իրականացնող մարմնի որոշումն ընդունվել է քրեադատավարական նորմերի խախտմամբ, հանգեցրել Ա. Քոչարյանի իրավունքների և ազատությունների խախտման և ենթակա է վերացման, փաստաբանները դիմում-բողոք են ներկայացրել Երևանի ընդհանուր իրավասության դատարան:

Վկայակոչելով Սահմանադրության, Մարդու իրավունքների եվրոպական կոնվենցիայի և ՀՀ քրեական դատավարության օրենսգրքի մի շարք հոդվածներ, Ա. Զալյանը և Ա. Չատինյանը ներկայացված բողոքում ծանրակշիռ հիմնավորումներ են ներկայացրել: Դրանք որոշիչ կարող էին լինել գործի ելքի հարցում, եթե հաշվի առնվեին վարույթն իրականացնող մարմնի կողմից: 

Բողոքում, մասնավորապես, ներկայացվել են Ա. Քոչարյանի՝  խոշտագումներից  զերծ մնալու, ազատության և անձնական անձեռնմխելիության իրավունքների խախտումները հավաստող փաստարկներ:
