Ինչպես հայտնել էինք այսօր, նախկին գլխավոր դատախազ Գևորգ Կոստանյանի նկատմամբ ընտրված խափանման միջոց կալանավորումը չի վերացվի:

Հարցի առնչությամբ Գևորգ Կոստանյանի փաստաբանը՝ Գևորգ Գևորգյանը, ԼՈՒՐԵՐ.com-ի հետ զրույցում ասաց, որ այսօր ՀՀ վերաքննիչ քրեական դատարանն ակնհայտ ապօրինի որոշում է կայացրել, մերժելով Գևորգ Կոստանյանի պաշտպանների բողոքը. «Այսինքն՝ դատարանը հրաժարվել է Գևորգ Կոստանյանի նկատմամբ առանց որևէ ապացույցի, առանց որևէ իրավական կամ փաստական հիմքի կիրառված խափանման միջոց կալանավորումը վերացնելուց, այն դեպքում, երբ միջազգային հեղինակություն ունեցող կառույցը՝ Քրեական ոստիկանության միջազգային կազմակերպությունը (Ինտերպոլը) Գևորգ Կոստանյանի նկատմամբ իրականացվող քրեական հետապնդումը գնահատել է որպես անօրինական և քաղաքական»,- նշեց փաստաբանը:

Ըստ վերջինիս՝  դատարանը հաշվի չի առել այն հանգամանքը, որ Սահմանադրական դատարանը հակասահմանադրական է ճանաչել ՀՀ քրեական օրենսգրքի 300.1 հոդվածը (սահմանադրական կարգը տապալելը). «Ռոբերտ Քոչարյանի և մյուսների նկատմամբ արդարացնող հիմքով քրեական հետապնդումը դադարեցվել է, հետևաբար Գևորգ Կոստանյանի նկատմամբ իրականացվող քրեական հետապնդումը նույնպես ենթակա է դադարեցման՝ արդարացնող հիմքով, իսկ խափանման միջոց կալանավորումը՝ վերացման, քանի որ ենթադրյալ սահմանադրական կարգի տապալումը հանդիսանում է Գևորգ Կոստանյանին մեղսագրված արարքների հանցակազմերի պարտադիր հատկանիշ, որի բացակայությունն ինքնին վկայում է Գևորգ Կոստանյանի արարքներում հանցագործության հանցակազմի բացակայության մասին»,- նշեց Գևորգ Կոստանյանի փաստաբանը:

Նա ասաց, որ տվյալ իրողությունը հասկանալու և գիտակցելու համար նույնիսկ իրավաբանական գիտելիքներ անհրաժեշտ չեն, ակնհայտ է, որ սահմանադրական կարգի տապալումը հակասահմանադրական ու անվավեր ճանաչելու պայմաններում սահմանադրական կարգի ենթադրյալ տապալումն իբրև թե թաքցնելն ինքնին դադարում է քրեորեն պատժելի արարք հանդիսանալուց. «Իրադարձությունների նման դասավորությունից տեսանելի է, որ ՀՀ վերաքննիչ քրեական դատարանի կողմից կայացված դատական ակտն ակնհայտ ապօրինի և հիմնազուրկ է և այն կրում է բացառապես քաղաքական բնույթ, այսինքն՝ դատարանը նման որոշմամբ վարույթն իրականացնող մարմնին առանց որևէ հիմնավորման թույլատրել է շարունակել հեղինակավոր միջազգային կառույցի՝ Ինտերպոլի կողմից որպես քաղաքական գնահատված և Սահմանադրական դատարանի կողմից որպես անվավեր ճանաչված նորմով իրականացվող անօրինական հետապնդումը»,- եզրափակեց Գևորգ Գևորգյանը:
