Ինչպե՞ս կարող է ընդդիմությունը ցրել խորհրդարանը

Արտահերթ խորհրդարանական ընտրությունների ավարտից և արդյունքների ամփոփումից հետո համացանցում և փորձագիտական տարբեր շրջանակներում քննարկվում են սցենարներ, որոնց միջոցով ընդդիմությանը կհաջողովի առնվազն սահմանադրական ճգնաժամ առաջացնել, ինչն էլ կհանգեցնի խորհրդարանի ցրմանը:

Նշենք, սակայն, որ նման հնարավորություն ընդդիմությունը գրեթե չունի:  Հայաստանի Հանրապետության Սահմանադրությամբ հստակ ամրագրվում են այն բոլոր դեպքերը, երբ Ազգայի ժողովը կարող է արձակվել։ Մասնավորապես, Ազգային ժողովն արձակվում է, եթե երկու անգամ անընդմեջ վարչապետ չի ընտրում, կամ եթե երկու անգամ անընդմեջ հավանության չի արժանացնում կառավարության ծրագիրը։

Սահմանադրությունը չի նախատեսում դեպքեր, երբ ԱԺ-ն կարող է արձակվել մանդատները վայր դնելու դեպքում։ Ավելին, Սահմանադրությամբ չի ամրագրվում, որ ընդդիմությունը պետք է կազմի խորհրդարանի ⅓-ը։ Սա կարգավորվում է Ընտրական օրենսգրքով, որի համաձայն՝ մանդատների բաշխման ժամանակ ընդդիմությանը պետք է տրվեն լրացուցիչ մանդատներ, այնքան, որ արդյունքում նրանց մանդատների ընդհանուր թիվը լինի Ազգային ժողովի մանդատների ընդհանուր թվի մեկ երրորդից ոչ պակաս (հոդված 96)։ Սա, սակայն, չի նշանակում, որ ընդդիմությունը հետագայում միշտ պետք է ունենա  մանդատների առնվազն ⅓-ը։ Այլ կերպ ասած՝ եթե ընդդիմադիր պատգամավորների թիվը Ազգային ժողովում նվազեց կամ ավելացավ, Ազգային ժողովը չի կարող դառնալ հակասահմանադրական։

Միակ քիչ թե շատ հավանական տարբերակը հետևյալն է՝ ԱԺ անցած ընդդիմադիր քաղաքական ուժերը հրաժարվում են վերցնել մանդատները, նույնը անում են նաև ընտրություններին մասնակցած մյուս բոլոր քաղաքական ուժերը: Ահա այս դեպքում սահմանադրական ճգնաժամ իսկապես առաջանալու է, քանի որ խորհրդարանը չի կարող կազմված լինել միայն իշխանությունից: Սակայն, այս տարբերակն էլ քիչ հավանական է այն պարզ պատճառով, որ խորհրդարան չանցած ուժերից շատերը մեծ սիրով կհամաձայնվեն վերցնել մանդատները և այս հարցում լայն կոնսենսուս լինել պարզապես չի կարող:

Ինչպես տեսնում ենք` Սահմանադրությունը և Ընտրական օրենսգիրքը գրված ու կազմված են այնպես, որ ընդդիմության ԱԺ-ն ցրելը դառնա գրեթե անհնար:
