«Առուշ Առուշանյանին որպես մեղադրյալ ներգրավելու որոշումը, ինչպես նաև նրա նկատմամբ կալանավորումը որպես խափանման միջոց կիրառելու միջնորդություն հարուցելու մասին քննիչի միջնորդությունը կայացրել է քննիչ Խ․ Մեջլումյանը, այնինչ տվյալ գործով նախաքննության կատարումը հանձնարարվել է քննչական խմբին, որի ղեկավարն ըստ նյութերի, որոնք տրամադրվել են պաշտպանության կողմին և դատարանին հանդիսացել է քննիչ Արման Մանուչարյանը։
Մինչդեռ ՀՀ քրեական դատավարության օրենսգրքի 195-րդ հոդվածի 2-րդ մասի համաձայն՝
 
Գործերը միացնելու կամ անջատելու, անձին որպես մեղադրյալ ներգրավելու, գործի վարույթը կարճելու, քրեական հետապնդումը դադարեցնելու, գործով վարույթը կասեցնելու կամ վերսկսելու մասին որոշումները, ինչպես նաև նախաքննության ժամկետը երկարացնելու, կալանքը որպես խափանման միջոց ընտրելու և դրանց ժամկետը երկարացնելու միջնորդություններ հարուցելու մասին որոշումներն ընդունում է միայն քննչական խմբի ղեկավարը:
 
Այսինքն ակնհայտ է, որ Առուշ Առուշանյանի նկատմամբ հարուցված քրեական հետապնդումն ապօրինի է և նրա նկատմամբ ընտրված կալանքը նույնպես, ուստի Ա․ Առուշանյանն անհապաղ պետք է ազատ արձակվի։
 
Ենթադրում եմ, որ ՀՔԾ-ն և Գլխավոր Դատախազությունը կփորձեն ներկայացնել իրականությունն այնպես, թե իբրև առկա է քննչական խմբի նոր ղեկավար նշանակելու մասին որոշում, որը շատ պատահաբար չի տրվել թե պաշտպանության կողմին և թե դատարանին։ Չի ստացվելու: Նման փորձի դեպքում ողջամիտ կասկած է ստեղծվելու այդ որոշման կեղծ լինելիւ մասին»:
