Աշխատանքի և սոցիալական հարցերի նախարարությունը հաղորդագրություն է տարածել, որում ասվում է.

«Աշխատողի և գործատուի միջև աշխատանքային հարաբերությունները ծագում են աշխատանքային օրենսդրությամբ սահմանված կարգով կնքված գրավոր աշխատանքային պայմանագրով կամ աշխատանքի ընդունման մասին անհատական իրավական ակտով:

Աշխատանքային պայմանագիրը համաձայնություն է աշխատողի և գործատուի միջև, ըստ որի` աշխատողը պարտավորվում է գործատուի համար կատարել որոշակի աշխատանք, իսկ գործատուն՝ աշխատողին տրամադրել պայմանագրով որոշված աշխատանքը, վճարել նրա կատարած աշխատանքի համար պայմանավորված աշխատավարձը և ապահովել օրենսդրությամբ սահմանված աշխատանքային պայմանները։ Դրանում պարտադիր պետք է նախատեսվի հիմնական աշխատավարձի չափը և (կամ) այն որոշելու ձևը, աշխատաժամանակի ռեժիմը, ամենամյա արձակուրդի տեսակը, տևողությունը և այլն։

Աշխատանքի ընդունվելիս գործատուն պարտավոր է աշխատանքային պայմանագիր կնքել աշխատողի հետ։ Այն կնքվում է նաև փորձաշրջան անցնող աշխատողների հետ (փորձաշրջանի ժամկետն առավելագույնը 3 ամիս է, ՀՀ օրենսդրությամբ նախատեսված դեպքերում՝ մինչև 6 ամիս)։

Աշխատանքային պայմանագիրը կազմվում է 2 օրինակից, որի մեկ օրինակը գործատուն հանձնում է աշխատողին՝ այն ստորագրելուց հետո 3 օրվա ընթացքում։ Այն, որպես կանոն, կնքվում է անորոշ ժամկետով՝ բացառությամբ, եթե աշխատանքային հարաբերությունները չեն կարող որոշվել անորոշ ժամկետով` հաշվի առնելով կատարվելիք աշխատանքի բնույթը կամ կատարման պայմանները։

Աշխատանքային պայմանագիրը կարող է լուծվել կողմերի համաձայնությամբ, աշխատողի կամ գործատուի նախաձեռնությամբ, ինչպես նաև Աշխատանքային օրենսգրքով սահմանված այլ հիմքերով։

Գործատուի նախաձեռնությամբ այն կարող է լուծվել, օրինակ՝ կազմակերպության լուծարման, հաստիքների կրճատման, անհարգելի պատճառով ամբողջ աշխատանքային օրվա (հերթափոխի) ընթացքում աշխատողի` աշխատանքի չներկայանալու դեպքերում։

Գործատուն աշխատողին չի կարող աշխատանքից ազատել վերջինիս ժամանակավոր անաշխատունակության, արձակուրդում գտնվելու ժամանակահատվածներում՝ բացառությամբ կազմակերպության լուծարման դեպքի»։
