Փաստաբանը դիմել է ՀՀ մարդու իրավունքների պաշտպան Արման Թաթոյանին՝ իր անչափահաս վստահորդի անձնական տվյալները «Դատալեքս» դատական տեղեկատվական համակարգից հեռացնելուն աջակցելու հարցով։ Այս մասին հայտնում են ՀՀ մարդու իրավունքների պաշտպանի աշխատակազմի հանրային կապերի բաժնից:

Նա նշել է, որ երեխան տուժող է ճանաչված սեքսուալ բնույթի բռնի գործողության հոդվածով նախատեսված հանցագործության հատկանիշներով, սակայն խնդրահարույց է, որ երեխայի անձնական տվյալները համակարգում հրապարակային են, ինչի հետևանքով հնարավոր է նույնականացնել երեխային:

ՀՀ մարդու իրավունքների պաշտպանի աշխատակազմից կապ են հաստատել դատավորի օգնականի, ՀՀ դատական դեպարտամենտի ներկայացուցչի, ՀՀ դատական իշխանության համակարգչային ծառայության պետ հետ։ Վերջինս հայտնել է, որ հնարավոր է դատական գործի որևէ կողմի դիմումի հիման վրա «Դատալեքսում» մուտքագրված անձնական տվյալները դարձնել գաղտնի:

Փաստաբանին փոխանցվել է համապատասխան ինֆորմացիան, ավելի ուշ Պաշտպանի աշխատակազմին փաստաբանը տեղեկացրել է, որ երեխայի տվյալները փակվել են։

Այդ թեմային ՀՀ մարդու իրավունքների պաշտպանն անդրադարձել է 2020 թվականի տարեկան հաղորդման մեջ՝ նշելով, որ արդիական խնդիր է անձնական տվյալների պաշտպանության օրենսդրական ոչ լիարժեք կարգավորումները դատական ակտերի հրապարակման շրջանակում:

Խնդիրն այն է, որ չնայած առկա օրենսդրական պահանջի, որով սահմանել է դատական իշխանության պաշտոնական կայքում անձնական տվյալների ապանձնավորման հնարավորություն, այնուամենայնիվ, գործնականում դրա լիարժեք իրականացումն ապահովող գործուն կառուցակարգեր ներդրված չեն:

Սա նշանակում է, որ մարդու անձնական կամ ընտանեկան կյանքի մանրամասներն առանց որևէ ողջամիտ հիմնավորման շարունակում են հասանելի լինել հրապարակային տիրույթում: Ստացվում է՝ բավական է մարդը գոնե մեկ անգամ առնչվի դատական համակարգի հետ, իր անձնական ու ընտանեկան կյանքը դառնում է հանրային սեփականություն: Նկարագրվածն անընդունելի է մարդու իրավունքների տեսանկյունից:

ՀՀ մարդու իրավունքների պաշտպանը խնդիրը կարգավորելուն ուղղված առաջարկներ է ներկայացրել՝

1. հնարավորինս սեղմ ժամկետում ներդնել դատական իշխանության պաշտոնական կայքում հրապարակվող դատական ակտերում անձնական տվյալների ապանձնավորման ծրագիրը,

2. հասարակությանն իրազեկել այն մասին, որ ՀՀ դատական դեպարտամենտին ուղղված դիմումի հիման վրա հնարավոր է սահմանափակել դատական իշխանության պաշտոնական կայքում հրապարակված դատական ակտերում անձնական տվյալների հասանելիությունը:
