Դավիթ Տոնոյանի փաստաբանական խումբը հայտարարություն է տարածել նախկին ՊՆ ղեկավարի քրգործի վերաբերյալ։

«Ստացել ենք Դավիթ Տոնոյանին կալանքի տակ պահելու ժամկետը երկարացնելու մասին դատարանի որոշումը: Վերահաստատում ենք, որ այն ամբողջությամբ անհիմն է, չփաստարկված և չպատճառաբանված, որի կապակցությամբ մանրամասն մեր առարկությունները ներկայացնելով՝ այն բողոքարկել ենք վերաքննության կարգով: Վերաքննիչ բողոքը մակագրվել է դատավոր Տիգրան Սիմոնյանին, և դատական նիստ է նշանակվել 2021 թվականի դեկտեմբերի 17-ին՝ ժամը 15:00-ին:

Ինչպես արդեն նշել էինք, վարույթն իրականացնող մարմինը անկատար է թողել նշանակված դատանյութագիտական, պայթյունատեխնիական-ապրանքագիտական համալիր փորձաքննությունը և դրա փոխարեն նշանակել է դատատեխնիկական փորձաքննություն: Դրա հետ միասին մինչ օրս Դավիթ Տոնոյանի մեղադրանքի վերաբերյալ քրեական գործով որևէ ապացույց ձեռք չի բերվել, և հակառակը, սպառազինության պահպանման և շահագործման ցուցանիշների վերաբերյալ համապատասխան փորձաքննություն իրականացնելու մեր միջնորդությունը մերժվել է:

Ուշադրության է արժանի նաև այն փաստը, որ փորձագետի եզրակացության մեջ և ամբողջ քրեական գործում շրջանառվում են սպառազինության շահագործման և պահպանության ժամկետների վերաբերյալ ՀՀ-ում չգործող, ՀՀ օրենսդրությամբ չվավերացված և չնախատեսված իրավական ակտեր և փաստաթղթեր, որոնք ՀՀ Վճռաբեկ դատարանի նախադեպային իրավունքի համաձայն՝ որևէ կերպ չեն կարող դրվել որևէ մեկի, այդ թվում՝ Դավիթ Տոնոյանի մեղադրանքի կամ քրեական պատասխանատվության հիմքում: Դրանք ԽՍՀՄ և ՌԴ ներքին, ներպետական օգտագործման փաստաթղթեր են, որոնք երբեք չեն վավերացվել ՀՀ-ում և լավագույն դեպքում կարող են ունենալ զուտ խորհրդատվական նշանակություն: Դրան հակառակ, սպառազինության գնման գործարքից շատ ավելի վաղ ՀՀ պաշտպանության նախարարությունում արձակվել է նախարարի համապատասխան հրաման, որով կարգավորվել են զինամթերքի պահպանության  կամ շահագործման ժամկետների հետ կապված հարցերը, ինչն էլ դրվել է 2018 թվականին կատարված գնման հիմքում:

Սա գալիս է ևս մեկ անգամ փաստելու, որ գործ ունենք ոչ օբյեկտիվ քննության հետ, վարույթն իրականացնող մարմինը փաստերի յուրովի և երբեմն իրականությունից կտրված մեկնաբանություններով,  բոլոր հնարավոր և անհնարին միջոցներով փորձում է հիմնավորել Դավիթ Տոնոյանի առնչությունը մեղսագրվող արարքը և նրան պահել կալանքի տակ»,-նշված է հայտարարությունում:
