Դատավոր Բորիս Բախշիյանի գործով դատախազությունը համառորեն պնդում է, որ դատավորն  առանց մեղադրյալի ներկայության քննարկելով նրա խափանման միջոցի փոփոխման հարցը, չի ապահովել վերջինիս լսվելու իրավունքը, ուստի եւ նրան կալանավորելով կայացրել է ակնհայտ ապօրինի դատական ակտ։ Այս մասին Facebook-ի իր էջում գրել է փաստաբան Էրիկ Ալեքսանյանը:

«Դատախազության նշված դիրքորոշման վերաբերյալ ունեմ մեկ նկատառում.

Ուրեմն իրավունքի տեսությունում առկա է «իրավունքից հրաժարվել» հասկացությունը, որը տարբեր իրավական համակարգերում եւ դոկտրիններում ընկալվում է տարաբնույթ ձեւով։ Ճիշտ է, իրավունքից հրաժարվելու հարցերը քննարկում են իրավունքի տարբեր ճյուղերի մասնագետները, սակայն այն առավել հետազոտված է քրեական դատավարության գիտության մեջ:

Որպես տեսական կատեգորիա՝ «իրավունքից հրաժարվել» հասկացությունը խաչվում է այնպիսի իրավաբանական հասկացությունների հետ, ինչպիսիք են՝ իրավունքից զրկելը, իրավունքը սահմանապակելը եւ այլն: Տեսաբանների մեծ մասն այն կարծիքին են, որ սուբյեկտիվ եւ օբյեկտիվ իրավունքները կրողի կողմից կատարած հակաիրավական արարքը կամ դրսեւորած ոչ իրավաչափ վարքագիծը որոշ դեպքերում կարող են դիտվել որպես սեփական իրավունքից հրաժարում։ 

Սույն դեպքով որպեսզի պարզենք, թե արդյոք դատավոր Բախշիյանն առանց մեղադրյալի ներկայության փոխելով նրա խափանման միջոցը զրկել է նրան  իր «լսվելու իրավունքը» իրացնելու հնարավորությունից, թե ոչ, պետք է գնահատել մեղադրյալի դրսեորած վարքագծի իրավաչափությունը։ 

Ինչպես հայտնի է տվյալ գործով դատական նիստի օրվա եւ ժամի մասին պատշաճ ծանուցված մեղադրյալը չի ներկայացել դատական նիստին, պատճառաբանելով, որ իր պաշտպանի բացակայության պայմաններում չի ցանկանում մասնակցել դատավարությանը այն դեպքում, երբ օրենսդրորեն մեղադրյալի պարտականությունն է մասնակցել դատական պրոցեսին, անկախ այն հանգամանքից ներկա է նրա պաշտպանը նիստին, թե ոչ:

Այսինքն ակնհայտ է, որ սույն դեպքում մեղադրյալը ծանոթ լինելով իր դատավարական իրավունքների եւ ՊԱՐՏԱԿԱՆՈՒԹՅՈՒՆՆԵՐԻ մասին, ինչպես նաեւ պարտականությունների չկատարման արդյունքում վրա հասնող հետեւանքների մասին, փաստացի անհարգելի պատճառով չի ներկայացել դատական նիստին՝ դրսեւորելով ոչ պատշաճ վարքագիծ: Ընդ որում, ոչ իրավաչափ վարքագծի դրսեւորմամբ մեղադրյալն ինքն իրեն զրկել է իր «լսվելու» իրավունքից, այլ կերպ ասած՝ վերջինս գիտակցաբար անօրինական վարքագծով հրաժարվել է իր սեփական իրավունքից։ Հետեւաբար Դատավոր Բախշիյանի գործողությունները եւ կայացրած որոշումն իրավաչափ է:

Ի դեպ դատախազության հարգելի գործընկերներ, իրավունքից հրաժարվելու տեսական հարցերը պատմականորեն առավել ուսումնասիրված է եղել հռոմեական իրավունքում, ուստի կալանքի նիստից առաջ խորհուրդ կտայի ընթերցել դասագիրքը»:
