Վարչական դատարանը վերահաստատել է ՄՊՀ դիրքորոշումը հավի ձվի շուկայում գերիշխող դիրքի չարաշահման մասին

Վարչական դատարանը թիվ ՎԴ/9807/05/21 գործով 2021 թվականի փետրվարի 9-ին կայացրած վճռով մերժել է «Աշտարակ ձու» սահմանափակ պատասխանատվությամբ ընկերության հայցը՝ վերահաստատելով Մրցակցության պաշտպանության հանձնաժողովի 2021 թվականի հուլիսի 27-ի թիվ 174 որոշմամբ արտահայտված դիրրքորոշման իրավաչափությունը։  

Հիշեցնենք, որ հանձնաժողովը վերոնշյալ որոշմամբ «Արաքս թռչնաֆաբրիկա» փակ բաժնետիրական ընկերության, «Արզնու տոհմային ԹՏԽ» բաց բաժնետիրական ընկերության և «Աշտարակ ձու» սահմանափակ պատասխանատվությամբ ընկերության կողմից 2021 թվականի մարտ ամսվա ընթացքում հավի ձվի իրացման գների բարձրացումը որակել էր որպես գնի չհիմնավորված բարձրացմամբ գերիշխող դիրքի չարաշահում:

«Աշտարակ ձու» սահմանափակ պատասխանատվությամբ ընկերության նկատմամբ կիրառվել էր տուգանք 15 039 156 դրամի չափով:

Հավելենք նաև, որ «Արաքս թռչնաֆաբրիկա» փակ բաժնետիրական ընկերությունը չի բողոքարկել հանձնաժողովի որոշումը, «Արզնու տոհմային ԹՏԽ» բաց բաժնետիրական ընկերության հայցի վերաբերյալ Վարչական դատարանը դեռևս վճիռ չի կայացրել:
