Սույն թվականի մայիսի 16-ից ունենք այնպիսի իրավիճակ, երբ ոստիկանության ծառայողների կողմից իրազեկման ավտոերթ իրականացնող քաղաքացիների տրանսպորտային միջոցները առանց հիմնավորման տարվել են հատուկ պահպանվող տարածք և մինչ օրս չեն վերադարձվում սեփականատերերին։ Այս մասին Facebook-ի իր էջում գրել է ԱԺ մարդու իրավունքների պաշտպանության և հանրային հարցերի հանձնաժողովի նախագահ Թագուհի Թովմասյանը՝ տեղեկացնելով, որ այս հարցի վերաբերյալ գրություն է ուղարկել ոստիկանապետ Վահե Ղազարյանին։

Նա, մասնավորապես, նշել է. «Ընդ որում՝ մեքենաների սեփականատերերին Ոստիկանության կողմից չի տրվել այն հիմնավոր պատճառաբանությունը, թե ինչ հիմքով են իրենց տրանսպորտային միջոցները պահվում հատուկ պահպանվող տարածքում։ Ստացվում է՝ Ոստիկանությունն ուղղակի առգրավել է ՀՀ քաղաքացիների գույքը և ոչ վերադարձնում է, ոչ էլ նշում է, թե ինչ հիմքով չի վերադարձնում: Սա ամենաթողություն է…

Արձանագրենք, որ տրանսպորտային միջոցների հատուկ պահպանվող տարածք տանելը և այն դրանց օրինական տիրապետողներին չվերադարձնելը առանց իրավական հիմնավորման՝ խախտում է քաղաքացու մի շարք իրավունքները, այդ թվում՝ սեփականության իրավունքը։ Հետևաբար, Ոստիկանության նման գործողությունները չեն բխում օրենքից, դրանք անձի սեփականության իրավունքին ակնհայտ անհամաչափ միջամտություն են, և այդ տրանսպորտային միջոցները պետք է անհապաղ վերադարձվեն դրանց օրինական տիրապետողներին։

Նկատի ունենալով, որ ներկայացրած հարցի լուծումը ենթակա է ՀՀ Ոստիկանության իրավասությանը, գրություն եմ ուղարկել ՀՀ Ոստիկանության պետ Վահե Ղազարյանին և խնդրել եմ հանձնարարել համապատասխան մարմիններին՝ ուսումնասիրելու ներկայացված խնդիրը և տրամադրել տեղեկություն ստորև նշված հարցերի վերաբերյալ․

1. Սույն թվականի մայիսի 16-ից իրազեկման ավտոերթ իրականացնող քաղաքացիների տրանսպորտային քանի՞ միջոց է տարվել հատուկ պահպանվող տարածք և ի՞նչ հիմնավորմամբ։

2. Ոստիկանության կողմից ե՞րբ է նախատեսվում նշված քաղաքացիներին վերադարձնել հատուկ պահպանվող տարածքում գտնվող իրենց տրանսպորտային միջոցները։
