Մարդու իրավունքների պաշտպանի ուղերձը Բռնի անհետացումների զոհերի միջազգային օրվա առթիվ

Այսօր Բռնի անհետացումների զոհերի միջազգային օրն է, որը սահմանվել է ՄԱԿ-ի Գլխավոր ասամբլեայի կողմից ընդունված բանաձևով։
Մարդկանց բռնի անհետացումները մարդու իրավունքների բազմակի և շարունակական խախտումներ են։ Դրանք սկսվում են պետության ներկայացուցիչների և պաշտոնատար անձանց թույլտվությամբ կամ համաձայնությամբ, որին հաջորդում է անհետացած անձի գտնվելու վայրի ժխտումը կամ թաքցնելը:
Մարդկանց բռնի անհետացումները ծայրահեղ ծանր ազդեցություն ունեն ինչպես զոհերի վրա, ովքեր հաճախ ենթարկվում են խոշտանգումների և ապրում իրենց կյանքի համար մշտական վախի մեջ, այնպես էլ նրանց ընտանիքների վրա, ովքեր անտեղյակ են իրենց հարազատների ճակատագրից և ապրում են նրանց վերադարձի չփարատվող սպասումով:
 
Ցավալիորեն ժամանակակից աշխարհում ընթացող հակամարտությունները բռնի անհետացումների հանցագործության համար «բարենպաստ» միջավայր են ստեղծել, և մենք, դժբախտաբար, մեր օրինակով գիտենք ու շարունակում ենք կրել 44-օրյա պատերազմի ընթացքում ու դրանից հետո այս հանցագործության զոհերի ու հարազատների ցավն ու չմարող պայքարը:
Կարմիր խաչի միջազգային կոմիտեի 2022թ. օգոստոսին ներկայացրած տվյալների համաձայն՝ 2020թ. 44-օրյա պատերազմի հետևանքով 303 անձ Հայաստանից դեռևս անհայտ կորած է համարվում:
Ադրբեջանական իշխանությունների կողմից գերիների ու անհայտ կորած անձանց վերաբերյալ տեղեկությունների չտրամադրման կամ այդ տեղեկությունների աղճատման շարունակվող գործելակերպը ոչ այլ ինչ է, քան մարդու իրավունքների հարցերն օգտագործել միջազգային մարդասիրական իրավունքով արգելված քաղաքական նպատակների համար։
 
Ցավալիորեն բռնի անհետացումների դեպքերին միջազգային արձագանքման մեխանիզմներն այս օրերին դրսևորում են իրենց արդյունավետության պակասը, ինչն այս ուղղությամբ բոլոր դերակատարների հետ միայն ակտիվ աշխատելու պատճառ է։
Սրա հետ մեկտեղ, պետք է նկատել, որ միջազգային իրավունքով նախատեսված կանոնները կյանքի կոչելու համար, պետությունները պետք է ամրագրեն այդ նորմերը ներպետական օրենսդրությամբ և ձեռնարկեն անհրաժեշտ բոլոր քայլերը դրանց գործադրման համար: Ուստի, այս առումով Պաշտպանի աշխատակազմը պատրաստակամ է աշխատելու Հայաստանի Հանրապետության կառավարության հետ անհայտ կորած անձանց ու նրանց հարազատների իրավունքների ապահովման վերաբերյալ ներպետական օրենսդրության ու ինստիտուցիոնալ շրջանակի բարելավման ուղղությամբ։
 
Պաշտպանի իրավասության շրջանակում ձեռնարկելով բոլոր միջոցառումները անհայտ կորած անձանց գտնելու և նրանց աջակցություն տրամադրելու հարցում՝ խստորեն դատապարտում եմ բռնի անհետացման անխտիր բոլոր դեպքերը և կոչ անում միավորել ջանքերը ու ձեռնարկել անհրաժեշտ միջոցառումներ բռնի անհետացած անձանց գտնելու և վերջիններիս ու նրանց ընտանիքների իրավունքների արդյունավետ երաշխավորման ուղղությամբ։
