Ադրբեջանի վերահսկողության տակ հայտնված ՀԷԿ-երի հայ ներդրողներն արբիտրաժային վարույթ են նախաձեռնում

44-օրյա պատերազմի հետևանքով ադրբեջանական վերահսկողության տակ հայտնված փոքր ՀԷԿ-երի հայ ներդրողները մտադիր են միջազգային արբիտրաժային վարույթ նախաձեռնել Ադրբեջանի դեմ՝ պնդելով, որ Բաքուն 2020 թվականին տեղի ունեցած ռազմական գործողությունների հետևանքով առգրավել և յուրացրել է իրենց սեփականությունը։ Այս մասին հաղորդում է միջազգային արբիտրաժային ոլորտի անցուդարձին հետևող առաջատար մասնագիտացված կայքը՝ Global Arbitration Review-ն, գրում է «Ազատությունը»:

Ծանուցումը ներկայացվել է դեկտեմբերի 5-ին՝ փոքր ՀԷԿ-երի 19 հայ սեփականատերերի անունից։

Կայքի փոխանցմամբ՝ հայ ներդրողների շահերը ներկայացնում է նյույորքյան հեղինակավոր Willkie Farr & Gallagher իրավաբանական ընկերությունը։

Երևանում հայցվորների իրավաբանական թիմում, ըստ կայքի, ընդգրկված են արդադատության նախկին նախարար Դավիթ Հարությունյանի փաստաբանական գրասենյակի աշխատակիցներն ու երևանցի անկախ փաստաբան Նորայր Բաբաջանյանը։

Global Arbitration Review-ի վկայությամբ՝ հայցը վերաբերում է Մարտակերտի, Լաչինի և Քելբաջարի շրջաններում գտնվող 18 փոքր ՀԷԿ-երին, որոնց սեփականատերերի համոզմամբ՝ Ադրբեջանը դրանք յուրացնելով խախտել է Եվրոպական էներգետիկ խարտիայի մի շարք դրույթներ։1991 թվականին կնքված այս փաստաթուղթը նաև էներգետիկ ոլորտի միջազգային վեճերի հանգուցալուծման մեխանիզմ է նախատեսում՝ կա՛մ Ստոկհոլմյան արբիտրաժային պալատի, կա՛մ հատուկ այս կամ այն հայցը քննելու համար ստեղծվող հատուկ արբիտրաժային մարմնի միջոցով։ Թե որ տարբերակն է ընտրվելու Ադրբեջանի դեպքում, դեռ հստակ չէ:

Ըստ Global Arbitration Review-ի հոդվածագրի՝ ծանուցմանը հաջորդելու է եռամսյա ժամկետ, որից հետո միայն կարող է տրվել արբիտրաժային վարույթի պաշտոնական մեկնարկը։

Կայքի տեղեկություններով՝ հայցվորների կողմից Ադրբեջանին ներկայացված փոխհատուցման պահանջը հասնում է մի քանի հարյուր միլիոն դոլարի։ Global Arbitration Review-ն նաև տեղեկացնում է, որ վեճի առարկա հանդիսացող փոքր ՀԷԿ-երն այժմ ընդգրկված են AzEnergy պետական ընկերության կազմում։

«Մինչև 2020 թվականն ընկած ժամանակահատվածը Արցախի վերահսկողության տակ գտնվող շրջաններում աչքի ընկավ ենթակառուցվածքային ներդրումներով՝ մասնավորաբար վերականգնվող էներգետիկայի ոլորտում։ Տարածաշրջանն էներգետիկ առումով ինքնաբավ էր և 2018 թվականին սկսեց էլեկտրաէներգիա արտահանել նաև Հայաստան», - հիշեցնում է կայքը։
