Դատախազության տարածքային ստորաբաժանման ղեկավարը 5 ամիս ակտ չի կայացրել և «նկատողություն» է ստացել

Գլխավոր դատախազ Աննա Վարդապետյանի՝ 2022 թվականի դեկտեմբերի 23-ի հրամանով՝ ՀՀ դատախազության տարածքային ստորաբաժանման ղեկավարի նկատմամբ նշանակվել է «նկատողություն» տեսակի կարգապահական տույժ, գրում է դատախազության հանրային կապերի բաժինը։

Տույժի նշանակմանը նախորդած կարգապահական վարույթի շրջանակում հաստատվել է, որ Դատախազության տարածքային ստորաբաժանման ղեկավարը N քրեական գործը հարուցելուց հետո, քննիչի կողմից շուրջ 5 ամիս որևէ քննչական և վարութային գործողություններ չկատարելու պայմաններում, գործուն միջոցներ չի ձեռնարկել դատախազական հսկողությունը պատշաճ իրականացնելու համար, այդ կապակցությամբ որևէ դատախազական ակտ չի կայացրել: Արդյունքում, քրեական գործով (վարույթով) նախաքննություն չի կատարվել, ողջամիտ ժամկետում չեն ձեռնարկվել օրենքով նախատեսված անհրաժեշտ բոլոր միջոցները՝ գործի հանգամանքների լրիվ, բազմակողմանի և օբյեկտիվ հետազոտման, ինչպես նաև նախաքննությունը ողջամիտ ժամկետում ավարտելու համար։ Բացի այդ, Դատախազության տարածքային ստորաբաժանման ղեկավարը, իրավական հիմքերի բացակայության պայմաններում, առանց որոշում կայացնելու, ստանձնել է նույն քրեական գործով մինչդատական վարույթի օրինականության նկատմամբ հսկողությունը և որոշում կայացրել նախաքննության ժամկետը երկարացնելու՝ քննիչի միջնորդությունը բավարարելու մասին: Իր և մեկ այլ քրեական գործով տուժողների և մեղադրյալի (ամբաստանյալի) միջև հեռավոր ազգակցական կապի առկայությամբ պայմանավորված՝ դատարանում իրեն բացարկ ներկայացված լինելու պայմաններում, դատախազն ինքնաբացարկ չի հայտնել, և, մինչև վերոնշյալ հիմնավորմամբ ՀՀ գլխավոր դատախազի տեղակալի որոշմամբ վարույթից հեռացվելը, շարունակել է քրեական գործով իրականացնել մեղադրողի պարտականությունները՝ կասկածի տակ դնելով գործի արդարացի քննության սկզբունքի պահպանումը: 
Այս կապակցությամբ ՀՀ գլխավոր դատախազի կողմից ընդգծվել է, որ դատախազի անկողմնակալության վերաբերյալ «անաչառ դիտորդի» մոտ կարող է կասկած առաջանալ ոչ թե գործով տուժողների և մեղադրյալի հետ դատախազի ունեցած հեռավոր ազգակցական կապի, այլ այդ պայմաններում վերոնշյալ քրեական գործով թույլ տրված խախտումների և ձգձգումների առկայության պատճառով. կասկած է առաջացնում նշված հանգամանքների՝ խախտումներ, ձգձգումներ, ազգակցական կապ, համակցությունը, այլ ոչ թե ինքնին ազգակցական կապը:
