2024 թվականի հունվարից արդեն գործում է «Հանրային ծառայության մասին» օրենքում կատարված՝ հանրային ծառայողների ստացած նվերների ինստիտուտի կատարելագործմանն ուղղված փոփոխությունները: Նշված փոփոխությունների համաձայն՝ հանրային ծառայողին և հանրային պաշտոն զբաղեցնող անձին արգելվում է պաշտոնեական պարտականությունների հետ կապված որևէ նվեր ընդունել:

Որպես ոլորտային քաղաքականություն մշակող մարմին` Արդարադատության նախարարությունն ստացել է արձանագրություն, ըստ որի` Ազգային Ժողովի ֆինանասավարկային և բյուջետային հարցերի մշտական հանձնաժոովի նախագահ Գևորգ Պապոյանն օրերս X ընկերության կողմից ստացել է «Door» հայկական կոնյակ, որի թույլատրելիության հետ կապված պատգամավորի մոտ կասկած է առաջացել: Պապոյանն այդ նվերի թույլատրելիության հետ կապված դիմել է ԱԺ աշխատակազմի բարեվարքության հարցերով կազմակերպիչ Սոնա Տեպոյանին՝ խնդրելով այս հարցի շուրջ տրամադրել խորհրդատվություն: Ներկայացված խորհրդատվական կարծիքի համաձայն՝ նվերը համարվել է ոչ թույլատրելի: Խորհրդատվական կարծիք ստանալով՝ Գևորգ Պապոյանը նվերը բարեվարքության հարցերով կազմակերպչի միջոցով վերադարձրել է նվիրատուին:

Հիշեցնենք, որ թույլատրելի են միայն օրենքով սահմանված չորս խումբ նվերները (արարողակարգային, պաշտոնական այցերի ժամանակ տրվող նվերներ, կրթաթոշակ և այլն): Ըստ օրենքի գործող կարգավորումների՝ եթե պաշտոնատար անձն ստացել է նվեր, որը ողջամտորեն կարող է ընկալվել որպես պաշտոնեական պարտականությունների հետ կապված, ապա պարտավոր է նվերի թույլատրելիության վերաբերյալ խորհրդատվական կարծիքի դիմել և խորհրդատվական կարծիքի համաձայն նվերը թույլատրելի չլինելու դեպքում այն վերադարձնել նվիրատուին կամ համարժեք հատուցում վճարել:

Օրենքի նշված կարգավորումներն ուժի մեջ մտնելուց հետո արդեն գրանցվել է դեպք, երբ պաշտոնատար անձը, ստանալով ոչ թույլատրելի նվեր, բարեվարքության հարցերով կազմակերպչի խորհրդատվական կարծիքի հիման վրա այն վերադարձրել է նվիրատուին:
