Դատարանը կարճել է Օնիկ Գասպարյանն ընդդեմ Արմեն Սարգսյանի և Նիկոլ Փաշինյանի գործով վարույթը. «Փաստինֆո»

Վարչական դատարանը՝ դատավոր Մհեր Պետրոսյանի նախագահությամբ, կարճել է ՀՀ ԶՈՒ ԳՇ նախկին պետ Օնիկ Գասպարյանն ընդդեմ ՀՀ նախագահ Արմեն Սարգսյանի և Նիկոլ Փաշինյանի գործով վարույթը։ Այս մասին հայտնում է «Փաստինֆո»-ն:

Հիշեցնենք, որ ՀՀ ԶՈՒ ԳՇ նախկին պետ Օնիկ Գասպարյանը երեք հայցադիմում էր ներկայացրել ՀՀ վարչական դատարան՝ ընդդեմ նախագահ Արմեն Սարգսյանի և վարչապետ Նիկոլ Փաշինյանի՝ վիճարկելով իրեն ԳՇ պետի պաշտոնից ազատելու որոշման իրավաչափությունը։ Հայցադիմումներից մեկը մակագրվել էր Վարչական դատարանի դատավոր Մհեր Պետրոսյանին, որի նկատմամբ, ի դեպ ճնշման միջոցներ էին սկսվել հայցադիմումը վարույթ ընդունելու որոշում կայացնելուց հետո։ Նշված որոշումը դատական տեղեկատվական համակարգում ներբեռնվելուց հետո ԱԱԾ ներքին անվտանգության վարչության պետ Հրայր Ավետիսյանը մեկ այլ աշխատակցի հետ շտապել էր վարչական դատարան՝ փորձելով հանդիպել դատավորի հետ՝ մինչ նա կհասցներ քննության առարկա դարձնել հայցի ապահովման միջնորդությունը։

Դատավորը հրաժարվել էր ընդունել ԱԱԾ աշխատակիցներին ու նրանց այցի մասին տեղեկացրել ԲԴԽ-ին: Այդուհանդերձ, դատավորը քննարկել է փաստաբանների միջնորդությունն ու հայցի ապահովման միջոց կիրառելու որոշում կայացրել, ինչը ենթադրում էր, որ Օնիկ Գասպարյանը պետք է շարունակեր պաշտոնավարումը մինչև սույն գործով դատարանի վերջնական որոշումը, սակայն դատական ակտն այդպես էլ ի կատար չի ածվել: Ընդ որում՝ Նիկոլ Փաշինյանի ներկայացուցիչը միջնորդել էր հայցի ապահովման միջոցը վերացնել, ինչը մերժվել է։

Կայքի հաղորդմամբ՝ սույն գործի վարույթը կարճելու մասին որոշում դատարանը կայացրել է օրերս՝ նշելով, որ բացահայտվել են օրենքով նախատեսված՝ հայցադիմումի ընդունումը մերժելու հիմքեր։ Մասնավորապես, դատարանն արձանագրել է, որ օրենսդիրը նպատակ է հետապնդել վարչական արդարադատության համակարգում սահմանելու այնպիսի իրավական կարգավորում, որը կերաշխավորի անձի դատական պաշտպանության իրավունքի լիարժեք և արդյունավետ իրավունքի իրացումը, ըստ այդմ սահմանելով այն հայցերը, որոնց միջոցով անձինք անմիջականորեն ձեռնամուխ են լինում իրենց խախտված իրավունքների և ազատությունների դատական պաշտպանությանը:
