Օգոստոսի 22-ին Պրոբացիայի ծառայությունը դիմեց Սյունիքի մարզի ընդհանուր իրավասության դատարան՝ Գորիսի համայնքապետ Առուշ Առուշանյանի պատժատեսակը փոխելու եւ նրան կլանավորելու վերաբերյալ։ Մինչ այդ Պրոբացիայի ծառայությունը Առուշանյանին հրավիրել էր գրասենյակ, վերցրել հաշվառման, ներկայացրել 3 դատական ակտ, մեկով Առուշանյանը տուգանվել էր 700 հազար ՀՀ դրամով, մյուսով պետք է անցնի մեկ տարի եւ վեց ամիս փորձաշրջան, երրորդով՝ դատարանի որոշմամբ հինգ տարի չի կարող զբաղեցնել պետական պաշտոն։ Առաջին երկու որոշումը կատարվել էր, իսկ երրորդը` ոչ: ԳԳ

Գորիսի ավագանին երկուշաբթի օրը նիստ էր արել, քննարկել Պրոբացիայի ծառայության գրությունը, արձանագրել, որ դատական ակտով նշանակված այդ պատժատեսակը, որպես հիմք, նախատեսված չէ ՏԻՄ օրենքով ընտրված քաղաքապետին պաշտոնանկ անելու համար։ Պարզ ասած՝ ավագանին չի կարող այդ որոշումը կատարել. Դա կարող է կատարվել միայն եթե Առուշ Առուշանյանը հրաժարական տա։ Բայց որոշումն էլ ուղղված է ավագանուն: 


Մենք կապվեցինք Առուշանյանի փաստաբան Դավիթ Կարապետյանի հետ: «Դեռեւս չունենք նոր տվյալներ, պարզ կլինի մինչեւ օրվա վերջ»,-«Հրապարակ»-ի հետ զրույցում ասաց նա: Թե ի՞նչ եղանակով հնարավոր կլինի պաշտպանել Գորիսի քաղաքապետին, փաստաբանը սպասում է դատական նիստին, որ ծանոթանա Պրոբացիայի ներկայացրած փաստարկներին։ Սակայն պրոբացիայի ծառայության կողմից միջնորդությունը  ներկայացնելուց 7 օր անց դատարանն այն դեռեւս վարույթ չի ընդունել։ 

«Պրոբացիայի ծառայության հրապարակումից չի երեւում, թե ինչու են հասցեատեր ընտրել Առուշ Առուշանյանին, նա ի՞նչ կարգով պատժատեսակը ինքնուրույն պիտի կատարեր, երբ ավագանին արդեն արձանագրել էր, որ տվյալ դատական ակտով նշանակված այս կոնկրետ պատժատեսակը որպես հիմք նախատեսված չէ ՏԻՄ օրենքով ընտրված քաղաքապետին պաշտոնանկ անելու համար»,-նշեց փաստաբանը։

Այն, որ Պրոբացիայի ծառայությունը նման հարցով կարող է դիմել ավագանուն, փաստաբանի խոսքով՝ օրենքով նա լիազորված չէ։ Այս մասով` պարզաբանում ստանալու համար Առուշ Առուշանյանը դիմել է դատարան, դեռեւս պատասխան չեն ստացել։

«Պրոբացիայի ծառայությունը պետք է դիմեր Գորիսի աշխատակազմի վարչակազմին, որն այս դեպքում գոյություն չունի։ Միանգամից դիմել է ավագանուն, քանի որ ընտրովի պաշտոնների դեպքում այդ կառուցակարգը կիրառելի չի։ Պրոբացիայի ծառայության համոզմամբ՝ իրենք ճիշտ են արել` Առուշ Առուշանյանը խուսափում է պատիճը կատարելուց։ Մեր համոզմամբ՝ խուսափելու հանգամանք գոյություն չունի։ Որոշողը դատարանն է, դատարանը պետք է գնահատի»,-ասաց Առուշանյանի պաշտպանը։
