««Եվրաջաստը» հարցում կատարող մարմին չէ, այն օպերատիվ պլատֆորմն է, որը մեզ հնարավորություն է տալիս անմիջականորն կոնտակտ հաստատել այն երկրի հետ, որտեղ ուղարկել ենք մեր հարցումը»,- կառավարության նիստում հայտարարեց գլխավոր դատախազ  Աննա Վարդապետյանը՝ պարզաբանելով արդարադատության նախարար Գրիգորի Մինասյանի ներկայացրած նախագիծը։

Նախարարաը ներկայացրեց Եվրաջասթի և ՀՀ իրավասու մարմինների միջև դատական համագործակցության մասին համաձայնագրի կից աշխատակարգը, որը հնարավորություն է տալու համագործակցության հարցերով դատախազի ներկայացվածությանը, նրա գործունեության շրջանակին, մասնավորապես՝ Եվրաջասթի կոլեգիայի լիագումար նիստերի, աշխատանքային խմբի աշխատանքներին, ռազմավարական նշանակության հանդիպումներին, իրազեկման միջոցառումներին և ծրագրերին մասնակցության հետ կապված հարցերի կարգավորում ապահովել:

Ըստ արդարադատության նախարարի՝ աշխատակարգ-միջազգային պայմանագիրը նախատեսվում է ստորագրել ՀՀ գլխավոր դատախազի, Եվրաջասթի նախագահի և ՀՀ արդարադատության նախարարի կողմից Եվրաջասթի նախագահի՝ Երևան այցելության շրջանակում, որը նախատեսված է սեպտեմբերի 23-ին:


Դատախազը բացատրեց, որ խոսքը վերաբերում է քրեական վարույթի շրջանակներում Հայաստանի հարցումներին, բայց «Եվրաջաստն» ունի նաև տեղեկատվական բազա, որտեղ հասանելի են գյուքերի վերաբերյալ տվյալներ, որոնք քրեական վարույթի շրջանակներում ՀՀ իրավապահները իրավունք ունեն հայցել և ստանալ։

Հիշեցնենք, որ ԱԺ-ն ընդունել է Եվրաջասթի և ՀՀ իրավասու մարմինների միջև դատական համագործակցության մասին համաձայնագիրը, որի նպատակն է զարգացնել կազմակերպված հանցավորության, ահաբեկչության, փողերի լվացման, թրաֆիքինգի և այլ ծանր հանցագործությունների դեմ պայքարում Եվրաջասթի և ՀՀ իրավասու մարմինների միջև միջազգային համագործակցությունը: Համաձայնագիրը պետք է ստորագրվի նաև ՀՀ նախագահի կողմից:

Աննա Վարդապետյանը բացատրեց, որ խոսքն իրավական օգնության շրջանակում քրեական վարույթի ընթացքում երրորդ երկրներ ուղարկվող իրավական օգնության հարցումների և տարբեր տվյալների հայցման մասին, որոնք պաշտպանված են անհատական տվյալների պաշտպանության գործիքակազմով, այդ պատճառով դրանք չեն հրապարակվում, բայց օգտագործվում են քրեական վարույթների շրջանակում:

«Մեր դատախազը, որը կլինի այնտեղ, մեր կոնտակտային անձն է, և կոնտակտային անձի միջոցով մենք ապահովում ենք հարցումների օպերատիվ հասանելիությունը ԵՄ անդամ երկրներին և հարցում կատարելու ժամանակ խնդիրների շատ արագ և օպերատիվ լուծումը»,-ասաց Վարդապետյանը:
