Khachatur Sukiasyan can’t be nominated for the President

A few days ago there was a publication in press, according to which businessman ANC member Khachatur Sukiasyan can be nominated in coming presidential elections.
Note, at NA elections held on May 6, 2012, Khachatur Sukiasyan was included in ANC’s proportional list, as well as was nominated in N10 precinct by majoritarian elections system. But the latter didn’t register as a deputy candidate, as it turned out through the message spread by the Police turned out, that data on Khachatur Sukiasyan don’t correspond to "the last five years of permanent residence in the Republic of Armenia" law demand. Particularly, Khachatur Sukiasyan lived incessantly beyond RA for a long time.
After the ANC member wasn’t registered, his brother Saribek Sukiasyan was registered, but the later failed to win.
According to Article 64 of RA Constitution and Article 105 of RA Electoral Code: any person having attained the age of twenty five, having been a citizen of the Republic of Armenia- for the preceding five years, having permanently resided in the Republic for the preceding five years, and who has the right to vote, may be elected as a Deputy.
According to Article 50 of RA Constitution and Article 105 of RA Electoral Code: every person having attained the age of thirty five, having been a citizen of the Republic of Armenia for the preceding ten years, having permanently resided in the Republic for the preceding ten years, and having the right to vote is eligible for the Presidency.
From here it can be stated, that Khachatur Sukiasyan even in case of nomination can’t be registered as a candidate for the president.
