State of Human Rights in the Ministry of Urban Development

The following shortcomings and developments were registered in the Ministry of Urban Development.

• Numerous complaints were received regarding the organization of the apartment (house) providence for the people who were left homeless in the disaster zone after the earthquake.

• The registered multiple violations in the sphere are concerning, in particular, the cases of unauthorized constructions, which indicates that the Ministry does not implement sufficient supervision and needed steps.

• The issue of adaption of the building for the needs of disabled remained unsolved.

Registered positive developments:

• For the compliance with the requirement of the legislation about the registration of the half-built buildings and documents related to the process of contraction, with October 29, 2012, 240 order of the Ministry of Urban Development a working group was stabled to oversee the construction of the buildings.

• It is planned to put the draft law on “Supervision and control of urban constructions” into circulation again.

• The fact that the Ombudsman's recommendations were accepted by the Ministry of Urban Development are welcoming, and, as a result, a joint initiative was developed based on December 21, 2006, 1923-N decision of the RA Government and the joint document of May 26 1998 108-N of the Ministry of Urban Development and head of the RA Real Estate State Body to remove the word “leak”, that will eliminate the current various interpretations of that issue.
