Helsinki Civil Assembly Vanadzor Office v. RA Prosecutor General’s Office

Today, on August 7, 2012, at 16:30 at the First Instance Court ( judge- G. Khanzadyan) of Kentron and Nork-Marash administrative districts of Yerevan, a trial will take place between the Helsinki Civil Assembly Vanadsor Office and the RA Prosecutor General's Office with the following demand:
To oblige the RA Prosecutor General’s office to realize the verdict of RA Court of Criminal Appeals made on May 30, 2011.
Note that the "CSI", "Helsinki Committee of Armenia" and "Helsinki Civil Assembly Vanadzor Office" NGOs (hereinafter referred to as organizations) presented notifications to RA Prosecutor General, with a demand to initiate a criminal case concerning the illegal keeping of citizen Sargis Poghosyan at “Nubarashen” Penal Institution for nearly 1.5 months.
RA citizen Sargis Poghosyan, who was being invetigated by US law enforcement authorities, has been arrested at “Zvartnots” airport, and kept at “Nubarashen” PI from August 5 to September 1, 2010, without the presence of the court’s verdict.
The fact was found out by the observers implementing control over the PIs and submitted to the law enforcement authorities with a demand to initiate a criminal case.
RA citizen Sargis Manuk Poghosyan has been kept at “Nubarashen” PI from August 5 to September 1, 2010, without any groundings in the frames of law.
Sargis Manuk Poghosyan, being investigated from 29.07.2010 by US law enforcement authorities, with a suspicion of crime according to 1344 and1349 articles, has been taken to DF of Yerevan City Department of RA Police on August 2, 2010, by officers of PD of “Zvartnots” airport and RA Chief Department of Police Criminal Investigation.
On May 30, 2011, RA Criminal Court of Appeal examined the complainants of the organizations, satisfied the appeal, and decided to overturn the decision (complaint refusal) of First Instance Court of Kentron and Nork-Marash administrative Districts of Yerevan, made on January 18, 2011,and to oblige the investigative authorities to eliminate the violations of human rights and freedoms.
So far, the above-cited decision of the Court of Criminal Appeal has not been done by the RA Prosecutor General's Office.
